Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to fix special time scale of pay to the petitioner in the light of G.O.Ms.No.385, Finance (Pay Cell) Department, dated 01.10.2010 from the date of completion of three years in the post of Sanitary Worker based on the representation, dated 20.04.2019 within stipulated time to be fixed by this Court.

ORDER

This Writ Petition is filed for a direction to the respondents to fix special time scale of pay to the petitioner, in the light of G.O.Ms.No.385, Finance (Pay Cell) Department, dated 01.10.2010, from the date of completion of three years in the post of Sanitary Worker, based on the representation, dated 20.04.2019, within a stipulated time to be fixed by this Court. 2.Mr.V.R.Shanmuganathan, learned Special Government Pleader takes notice on behalf of the respondents. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

W.P.(MD) No.21192 of 2019 3.According to the petitioner, she was engaged as Sanitary Worker in the third respondent office on consolidated pay of Rs.500/-. Later, it was enhanced to Rs.1,500/- per month. The Government has issued G.O.Ms.No.385, Finance (Pay Cell) Department, dated 01.10.2010, to fix special scale of pay to the Sanitary Workers, who are working in the Government Office and local body on daily wages and consolidated pay basis. Therefore, the petitioner has made various representations. Lastly, he made a representation, dated 20.04.2019, to the respondents. However, no order is passed thereon. Hence, the petitioner has come out with the present Writ Petition.

4.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.

5.Considering the nature of relief sought for in the Writ Petition, without deciding the issues on merits, the respondents are directed to consider the representation of the petitioner, dated 20.04.2019, on merits and pass orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition stands disposed of. No costs.
