PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to conclude the appeal pending in N.K.B1.No.11856 of 2022 within the time stipulated by this Court and consequently forbear the 3rd respondent from making any entries in favour of the respondents in the patta pending disposal of the appeal before the 1st respondent. O R D E R

The petitioner herein seeks a direction to the first respondent to dispose of the revision pending in his proceeding in N.K.B1.No.11856 of 2022, within the time stipulated by this Court.

2. Heard the arguments of learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 3 and the learned counsel appearing for the respondents 2/6

4 to 6.

3. It is the case of the petitioner that patta for the property situate in S.No.158/2A, Enathi Group, Enathi Post, Thiruppuvanam Taluk, Sivagangai District, with an extent of 10 cents, was originally issued in the name of the petitioner. The private respondents 4 to 6 submitted an appeal before the second respondent seeking cancellation of the patta issued in the name of the petitioner. The second respondent allowed the appeal and ordered cancellation of the patta. Aggrieved by the same, the petitioner preferred a revision before the first respondent and the same is pending in his proceeding in N.K.B1.No.11856 of 2022. Though the revision was filed in the year 2022, till date no final order has been passed. Hence, the petitioner has come before this Court.

4. The learned Additional Government Pleader who appear for the respondents 1 to 3 would submit that the revision will be disposed of within the time stipulated by this Court.

5. In view of the same, this Court, without going into the merits of the claim made by the petitioner, directs the first respondent to dispose of 3/6

the revision pending in his proceeding in N.K.B1.No.11856 of 2022, within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and private respondents.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
