O R D E R
This Writ Petition has been filed seeking for a Mandamus to direct the respondents to absorb the petitioners as permanent Helper in regular time scale of pay in Tuticorin Thermal Power Station, Tamil Nadu Generation & Distribution Corporation Ltd., Tuticorin and to grant all attendant and other service benefits, within a time frame to be fixed by this Court.
2.The petitioners claim that they have been appointed on contract basis by TANGEDCO and they seek to be absorbed in TANGEDCO at their thermal power station in Tuticorin. The petitioners have given a representation on 27.03.2017, for the said purpose. Since the same has not been considered, they have filed this Writ Petition.
3.Till date, counter has not been filed by the respondents. This Writ Petition is of the year 2023. No prejudice will be caused to the respondents if the petitioners' representation as stated supra is considered on merits and in accordance with law by the respondents within a time frame to be fixed by this Court. This Court is not 3/6
expressing any opinion on the merits of the matter. It is for the respondents to consider the same on merits and in accordance with law.
4.For the foregoing reasons, this Court directs the fourth respondent to pass final orders on the petitioners' representation dated 27.03.2017, seeking to absorb them as permanent Helper in regular time scale of pay in Tuticorin Thermal Power Station, Tamil Nadu Generation & Distribution Corporation Ltd., Tuticorin and to grant all attendant and other service benefits on merits and in accordance with law within a period of twelve [12] weeks from the date of receipt of a copy of the order.
5.With the aforesaid direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
