Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the 3rd and 4th respondents not to lay any pavement road in SF.No.549/2A in Nerkuppai Village, Thiruppathur Taluk, Sivagangai District, without surveying the pavement area as per 1/4

revenue records and consequently direct the 3rd and 4th respondents to construct storm drains for letting out the rain water before laying down the pavement road in consonance with Section 40(1) of the Tamil Nadu Urban Local Bodies Act, 1998, based on petitioner's representations dated 21.12.2022 and 08.08.2023.

ORDER

This Writ Petition has been filed to direct the respondents 3 and 4 not to lay pavement road in SF.No.549/2A, Nerkuppai Village, Thiruppathur Taluk, Sivagangai District, without surveying the pavement area as per revenue records and consequently direct those respondents to construct storm drains for letting out the rain water before laying the pavement road in consonance with Section 40(1) of the Tamil Nadu Urban Local Bodies Act, 1998, based on the petitioner's representations dated 21.12.2022 and 08.08.2023.

2. The learned Additional Government Pleader appearing for the respondents would submit that, in the present case, the land in which the pavement road was proposed to be laid is found to be a patta land. Hence, they are not going to lay any such pavement road. 2/4

3. In view of the above submissions, no further order is required to be passed in this Writ Petition. Recording the said submissions, this Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed.
