PRAYER :- For Anticipatory Bail in Crime No.1513 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner / Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC and Section 21(1) 1/3

of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No. 1513 of 2023, seek anticipatory bail.

2.The case of the prosecution is that on 19.07.2023, at about 7.00 a.m., the police official were found the petitioner transporting 2 units of river sand in a tipper lorry, illegally. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case and seek for the relief of anticipatory bail.

4. The learned Government Advocate (Crl.side) would submit that the petitioner is having thirteen previous cases and he is history sheeted in H.S. No.1 of 2023.

5. Considering the facts and circumstances of this case, and also considering that the petitioner is a habitual offender. There is no change of circumstance, but filing of repeated petition without any change of circumstance cannot be appreciated.
