ORDER

The present writ petition has been filed by the Driver working in the respondent Transport Corporation seeking a Mandamus to direct the respondents to modify the deduction from his salary towards the maintenance amount.

A perusal of the records reveal that, the petitioner's wife had initially filed an application seeking maintenance in M.C.No.11 of 2021 and the same was allowed on 20.05.2022 granting a sum of Rs.6,000/- as maintenance to the wife and another sum of Rs.4,000/- to the son. Pursuant to the said order, the respondent Transport Corporation was deducting a sum of Rs.10,000/- from his salary and remitting it to the Court.

3. The petitioner herein had filed a C.M.P.No.285 of 2022 and C.M.P.No.61 of 2023 in M.C.No.11 of 2021 before the Family Court, Karur seeking modification of the maintenance order, dated 20.05.2022. The Family Court was pleased to pass orders on 09.03.2023 cancelling the order of maintenance as against the wife. However, continuing to direct the petitioner to pay maintenance to his son. However, this modified order was not brought to the notice of the second respondent and therefore, the second respondent is continued to deduct a sum of Rs.10,000/- from the salary of the petitioner. Hence, the present writ petition.

The learned Standing Counsel appearing for the respondents submitted that they would comply with the orders of the Family Court, Karur, dated 09.03.2023 in C.M.P.No.285 of 2022 and C.M.P.No.61 of 2023 in M.C.No.11 of 2021 and pass orders, within a period of two (2) weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition stands disposed of. There shall be no order as to costs.
