Civil Revision Petition is filed under Article 227 of the Constitution of India, to Strike Off the plaint in O.S.No.799 of 2016 pending on the file of the Principal Subordinate Judge, Madurai.

ORDER : This Criminal Original Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/r.N.SATHISHBABU, Advocate for the petitioners, Mr.V.R.SHANMUGANATHAN, Advocate for the Respondent and in view of reasons given by the learned Principal Sub Judge, Madurai, the court made the following order:- This petition has been listed today for extension of time for disposing the suit in O.S.No.799 of 2016.

2.This Court has already disposed of the Civil Revision Petition by order dated 25.01.2017, by directing the trial Court to dispose of the suit in O.S.No.799 of 2016 as expeditiously as https://hcservices.ecourts.gov.in/hcservices/ possible, in any event, not later than 30.06.2017.

3. Earlier, the trial Court has also sought for further extension of time on two occasions for disposing of the above suit and this Court has also granted two months' time and another four months for disposal of the above suit. Now, the trial Court seeks further time for disposing the suit. Hence, the matter was listed today.

4. Hence, considering the facts and circumstances of the case, further one month time is granted from today to the trial Court for disposal of the suit in O.S.No.799 of 2016. The learned Principal Subordinate Judge, Madurai, shall keep in mind the attitude of the parties and dispose of the suit within the prescribed time.
