Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relate to the order of the 2nd respondent made in Na.Ka.No. 221/A2/2021, dated 22.03.2022, and quash the same as it is illegal and in consequence to direct the respondents to grant the terminal benefits i.e., DCRG of the deceased Kandavel, to the petitioner within a time to be fixed by this Court.

ORDER

The learned counsel appearing for the petitioner has circulated a letter to the Registry, seeking permission of this Court to withdraw this Writ Petition and hence, the matter is posted today under the caption "for withdrawal".

2.When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that the writ petitioner passed away and seeking liberty to the legal heirs of the petitioner to file a Succession Origional Petition before the concerned Court.

3.Recording the same, this Writ Petition is dismissed as withdrawn. No costs. However, liberty is given to the legal heirs of the deceased writ petitioner to file a Succession Original Petition before the competent Civil Court. Consequently, connected miscellaneous petition is closed.
