Civil Miscellaneous Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to condone the delay of 220 days in filing application to set aside the order dated 12.12.2023 pass by this Honourable Court in the above SA.No.68 of 2006 and thus render justice. Prayer in SA(MD). 68/ 2006 :

To prefer the Memorandaum of Grounds of Second Appeal against the judgement and decree dated 08.12.2004 in A.S.No.83 of 1998 on the file of I Additional Subordinate Court, Madurai, confirming the judgement and decree dated 12.03.1998 in O.S.No.76 of 1997 on the file of District Munsif Court, Melur. ORDER : This Civil Miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.SUBRAMANIAN, Advocate for the petitioner the Court made the following order:- This application has been filed seeking to condone the delay of 220 days in filing the application to set aside the order dated 12.12.2023.

2. Heard the learned counsel appearing for the petitioner.

3. Considering the reasons assigned in the affidavit filed in support of the application, this application is allowed and the delay is condoned on condition that the petitioner pays a sum of Rs.1,000/- (Rupees One Thousand only) in the name of Women Advocates Association, Madurai Bench of Madras High Court (Account No.6477041768, IFSC Code No.IDIB00H040, Indian Bank, High Court Branch, Madurai) for the purpose of maintaining Creche located in the campus of the Madurai Bench of Madras High Court, within a period of two weeks from today, failing which, the petition shall stand dismissed automatically without further 2/3

reference of this Court.

4. Post the matter on 16.10.2024.
