Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue Passport to the petitioner within the stipulated time as fixed by this Court based on the application submitted by him in File NO.MD10777189802324.

ORDER

This writ petition has been filed for a writ of Mandamus to directthe first respondent to issue Passport to the petitioner based on the application submitted by him in File NO.MD10777189802324.

2. The petitioner has filed an application on 12.05.2024. However, it has not been processed so far on account of the FIR registered against the petitioner in Crime No.121 of 2021 dated 28.04.2021 for offences under Sections 294(b), 406, 420, 468, 467 and 506 (2) of the IPC.

3. The learned Government Advocate for the second respondent submits the case is still under investigation and no charge sheet has been filed till date.

4. Considering the same, there can be no impediment for issuing a direction to the first respondent to process the petitioner's passport application.

5. Under these circumstances, there shall be a direction to the first respondent to process the petitioner's passport application as expeditiously as possible preferably. In case charge sheet is filed, the petitioner shall surrender the passport before the concerned court and thereafter, retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application.

6. It is also made clear that if the petitioner fails to comply with the above condition, the first respondent is at liberty to cancel the passport.
