PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus directing the respondents 1 to 3 to call for records relating to the impugned order Ka.No.Oo.Mi.Vi. Ne/Sayal/Co.Manu/A.No.182/2025-2026 dated 19.04.2025 passed by the 3rd respondent and quash the same consequently direct the 3rd respondent to provide electricity connection (domestic purpose) in the petitioner's EB No. 2000535411241055 to the petitioner's premises situated at Periyakulam Village and Panchayat, Kadaladi Taluk, Ramanathapuram District. ORDER
The petitioner is in possession of the property where the petitioner has put a dwelling unit and has sought for power connection. It appears that there is a private dispute between the petitioner and the fourth respondent and therefore, the fourth respondent has objected to grant provision of EB connection to the petitioner.

2. The official respondents have raised further objection stating that the petitioner has not produced any document from the revenue authorities and also the wiring work is not completed. It is however highly inconceivable as to why a person will apply for EB connection without wiring. As far as the private dispute between the petitioner and the fourth respondent is concerned, same has to be decided before the competent Court of civil jurisdiction.
3. Since the petitioner is already in possession of the property, the third respondent shall provide power connection provisionally. This power connection to be given to the petitioner within a period of two weeks and it will be however subject to any order that may be secured by the third respondent or by any of the revenue authority for evicting the petitioner from the property. The petitioner shall also execute necessary bond to secure the interest of the parties.
4. At this stage, learned Standing Counsel for the official respondents submits that the old application has been closed. It is therefore submitted that if the petitioner files a fresh application, EB connection will be granted in terms of 3/5
this order. Statement of the learned Standing Counsel for the official respondents stands recorded. The petitioner is therefore directed to submit a fresh application.
5. With the above observation, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed. 20.08.2025 Index : Yes / No Internet : Yes / No PJL To
