Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to survey and measure the Petitioner's property situated at S.No.193/1, Chinnamanur Town and to issue corrected patta as per the extent of the property as 3276 sq.ft(ie., 304.35 square meters) mentioned in sale deed NO.687/2013, on the basis of the Petitioner's representation, dated 27.6.2025 within the time frame fixed by this court.

O R D E R

The Petitioner herein seeks a direction to survey and correct the extent of property in the patta issued to him in respect of the property in S.No.193/1, Chinnamanur Town by considering his representation dated 27.6.2025. 2.Mrs.S.Jeya Priya, learned Government Advocate takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.The Petitioner said to have purchased the subject property with an extent of 3276 sq.ft = 304.35 sq.mts under registered sale deed of the year 2013. Patta for the subject property was also issued in the name of Petitioner. However the extent of the property is wrongly mentioned in the patta as 0.29.05 sq mts. Therefore the Petitioner submitted the instant representation on 27.6.2025 before the first respondent seeking correction of extent in the patta, after survey of the property. The same has not been considered till date. Hence, the Petitioner is before this Court with the present Writ Petition for the relief stated supra. 2/6

4.Mrs.S.Jeya Priya, learned Government Advocate, who takes notice for the respondents 1 and 2 would submit that for carrying out correction in the revenue records, the competent authority is the Revenue Divisional Officer and therefore, the representation of the Petitioner could not be considered by the first respondent.

5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to forward the representation of the Petitioner, dated, 27.06,2025 to the Revenue Divisional Officer, Uthamapalayam, Theni District within a period of two weeks from the date of receipt of a copy of this order. The said authority shall consider the representation of the Petitioner and pass final orders on its own merits after affording reasonable opportunity to the Petitioner, neighbouring land owners and other interested parties, if any, within a period of 12 weeks therefrom.

6.With the above directions, the Writ Petition stands disposed of. No costs.
