Heard the learned counsel on either side.

2. The petitioner questions the impugned order whereby one Shri.M.Ravi who has been working in Coimbatore Municipal Corporation on foreign service has been transferred back to Tirunelveli City Municipal Corporation to work in the place of the writ petitioner.

3. The learned counsel appearing for the writ petitioner took me through the averments set out in the 2/5

3 W.P.(MD)NO.22285 OF 2022 affidavit filed in support of the writ petition. He contended that the writ petitioner is a physically challenged individual and that when he was earlier transferred to Kumbakonam, he filed W.P.(MD)No.7412 of 2020 and obtained an interim order and by virtue of the same, he is continuing in Tirunelveli. The petitioner's apprehension is that if the impugned order is not stayed or set aside, Thiru.N.Ravi will come back to Tirunelveli City Municipal Corporation and the petitioner will be necessarily displaced.

4. I am of the view that the petitioner has no locus standi to question the order passed in favour of Shri.N.Ravi. Shri.N.Ravi was originally working in Tirunelveli City Municipal Corporation and he was transferred to Coimbatore Municipal Corporation only by way of deputation on foreign service. He has worked there for full ten years. Therefore, he is being brought back. No exception can be taken to the said order.

5. The petitioner can have grievance only if he is transferred out of Tirunelveli and displacement from his 3/5

4 W.P.(MD)NO.22285 OF 2022 existing post will not constitute infringement of the writ petitioner's right. Only if he is transferred to some other local body, the petitioner can have cause for complaint. If any such order is passed, it is for the petitioner to file a petition. As and when such a petition is filed, the same will be considered on merits and in accordance with law. With this liberty to the petitioner, this writ petition stands dismissed. No costs.
