When the matter is taken up for hearing today, learned counsel appearing for the respondent would submit that the sole respondent passed away on 04.09.2019 and he has also informed the same to the appellant.

Learned counsel for the appellant has not appeared before this Court today and the appellant has also not taken any steps to implead the LRs. of the deceased sole respondent, which shows that the appellant is not interested in prosecuting the case. Hence, the Second Appeal is dismissed for non-prosecution. No costs.
