PRAYER :- For Anticipatory Bail in Crime No.14 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 498(A), 406, 294(b), 506 (ii) IPC r/w Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002 in Crime No.14 of 2024 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner married the defacto complainant on 09.05.2016. There was some matrimonial dispute, as a result of which, the defacto complainant had given a complaint to the effect that the petitioner is demanding dowry and he is treating the defacto complainant with cruelty and has also driven her away from the matrimonial home. 3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent police. 4.An attempt was made by this Court to refer the parties for mediation in order 2/4

to amicably resolve the dispute. However, in spite of best efforts, the parties were not able to reach any settlement. Accordingly, the mediation report has been submitted before this Court.

5.Taking into consideration the facts and circumstances of the case and also considering the fact that there is a matrimonial dispute between the parties and the custodial interrogation may not be required in this case, the respondent Police is directed to resort to the procedure adumbrated under Section 35 of the BNSS Act and complete the investigation as expeditiously as possible. 6.This Criminal Original Petition is disposed of with the above terms. sd/- 25/11/2024 / TRUE COPY / /12/2024 Sub-Assistant Registrar (CS-I / II /III/ IV) Madurai Bench of Madras High Court, Madurai - 625 023.
