(R3 and R4 are suo motu impleaded vide order dated 26.02.2025) ... Respondents Writ Petition filed under Article 226 of the Constitution of India seeking for the issuance of a Writ of Mandamus, to direct the respondents 1/6

to consider the petitioner's representation and conduct further investigation on the complaint lodged by the petitioner dated 28.02.2024 within the time stipulated by this Court.

ORDER

The petitioner, on 28.02.204, has lodged a complaint as against a Revenue Inspector of Pattanamaruthur that she has assigned a land in Survey No.217/33 in favour of one Anusa Banu, when it has already been assigned to one Meenakshi. He further alleged that the Revenue Inspector has also issued a false certificate to one Thangamuniyasamy for his marriage registration, by suppressing his earlier marriage. The complaint of the petitioner was received by the Vigilance and AntiCorruption Department on 07.03.2024 and the same was also forwarded to the District Collector, Thoothukudi for necessary action. The District Collector, in turn, has referred the complaint to the Revenue Divisional Officer and directed him to ascertain the veracity of the complaint. The petitioner, with a grievance that his complaint dated 28.02.2024 was not 2/6

attended by the Vigilance and Anti-Corruption Department, has filed this writ petition seeking for a writ of Mandamus, directing the Vigilance and Anti-Corruption Department to conduct an enquiry based on his complaint dated 28.02.2024.

2. Since it was reported that the complaint of the petitioner was forwarded to the District Administration for necessary action, this Court, by its earlier order 26.02.2025, suo motu impleaded the District Collector, Thoothukudi and Revenue Divisional Officer, Kovilpatti, Thoothukudi and directed Mr.P.T.Thiraviam, learned Government Advocate, to take notice for the newly impleaded respondents and get instructions as to the course of action taken by them on the complaint of the petitioner, which was forwarded by the Vigilance and AntiCorruption Department.

3. The learned Government Advocate (Crl. Side) has produced a copy of the report of the Revenue Divisional Officer, Kovilpatti, which was forwarded by him to the District Collector, Thoothukudi in Na.Ka.No.Aa3-4398-2024 dated 12.12.2024 that a detailed enquiry was 3/6

conducted based on the petitioner's complaint. According to him, the land in Survey No.217/33 was allotted to one Meenakshi. However, in the allotment of one Anusa Banu, it was wrongly mentioned as Survey No.217/33 instead of survey No.217/35. The land, which was allotted to Anusa Banu, according to him, is only in Survey No.217/35 and not in Survey No.217/33. It is only a typographical error, which has been taken advantage of by this petitioner to lodge a complaint as against the Revenue Inspector. He further submits that the petitioner is having animosity as against the Revenue Inspector and therefore, he is targeting the Revenue Inspector. According to him, neither Meenakshi nor Anusa Banu has lodged any complaint as against the Revenue Inspector.

4. In view of the submissions made by the learned Government Advocate, this writ petition is closed.
