ORDER
The petitioner is a bus driver working in the respondent corporation. A case in Crime No.69 of 2019 dated 05.12.2019 was registered against the petitioner on the file of the Masarapatti Police Station, Thoothukudi District that he caused an accident with a two wheeler by rash and negligent driving. The respondent corporation also initiated disciplinary proceedings against the petitioner and imposed a punishment of stoppage of annual increment for 2 years with cumulative effect by order dated 15.01.2021. However, the petitioner's name was thereafter dropped from the array of accused in the final report filed before the learned Judicial Magistrate, Vilathikulam. By placing reliance on Clause 61 of the Settlement under Section 12(3) of the Industrial Disputes Act dated 30.09.1992 as per which the disciplinary action may 2/4
be revised in case of a honourable acquittal in the criminal case, the petitioner has filed this writ petition seeking a writ of mandamus to direct the respondents to revise and drop the punishment of stoppage of annual increment for 2 years with cumulative effect imposed by the 2nd respondent, by order dated 15.01.2021 and to pay him consequential monetary benefits including full wages for the suspension period and difference in wages payable to him.

Without challenging the original order of punishment dated 15.01.2021, the petitioner has filed this writ petition seeking a writ of mandamus to revise and drop the punishment imposed by the punishment order. Therefore, this writ petition is not maintainable and is dismissed with liberty to the petitioner to workout his remedy by filing an appeal as against the order of punishment and raise his grounds during the same. No costs.
