The petitioner/sole accused in Crime No.189 of 2024, on the file of the first respondent police has filed this petition, to quash the above proceedings initiated as against this petitioner. 2.The case in Crime No.189 of 2024 has been registered as against this petitioner, on the complaint of the second respondent that this petitioner, on 30.04.2024 at about 11:30 a.m has entered into the house of the defacto complainant with sword, abused him and also criminally intimidated him. The petitioner has moved this petition to quash the proceedings, on the ground that the defacto complainant is none other than his employer and he was working as a supervisor with the defacto complainant for more than ten years. The defacto complainant is running a modern Rice Mill and also doing Real Estate business. He is a multi millionaire in that village. The defacto complainant has not paid the salary promptly to the petitioner and when the same was questioned by him, a criminal case has been foisted as against the petitioner, as if he has abused and criminally intimidated. 2/5

3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the first respondent submits that the petitioner, who was working with the defacto complainant has been removed by him. Therefore, this petitioner went to the house of the defacto complainant with sword, abused him and also threatened him, which was noticed by three witnesses. The learned Government Advocate has pointed out apart from this case, the petitioner has involved in eight other criminal cases and the details have also been placed before this Court.

4.Considering the aforesaid submissions made by the learned Government Advocate, the nature of offence, antecedent of the petitioner, this Court is not inclined to entertain this petition. Accordingly, this Criminal Original Petition is dismissed. The investigating Officer is not supposed to conduct the investigation in a mechanical manner based on the statement made by the defacto complainant and the witnesses, if any, produced by the defacto complainant alone. The respondent police shall also conduct the investigation in Crime No.189 of 2024, in a fair manner, by considering 3/5

the case of the petitioner that he is the employee of the defacto complainant and has not been paid with the salary by him. Consequently, connected Miscellaneous Petition is closed.
