ORDER

Heard both sides.

2.The petitioner challenges the allotment made in favour of the fifth respondent enabling him to put up a house under what is known as Chief Minister's Green House Scheme.

3.The allegation of the petitioner is that the fifth respondent is having another house and that therefore, he is not eligible for any allotment.

4.The official respondents have filed counter affidavit stating that the property pointed out by the writ petitioner belongs to one Muthu and that the fifth respondent has nothing to do with the same. Except making a bald allegation, no material has been placed by the petitioner to substantiate his allegation. When the official respondents have categorically denied the same, the question of setting aside the impugned allotment order does not arise at all. It is also seen that the fifth respondent has already completed the construction way back in the year 2014 itself. The writ petition is without any merit and it stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
