ORDER
This writ petition has been filed for a Mandamus to direct the first respondent to renew the petitioner's passport in Application No.MD1075226579425 and bearing reference No.25-1054278236.

The petitioner has been arrayed as Accused No.8 in Crime No.113 of 2018 dated 05.05.2018, registered by the third respondent for offences under Section 147, 148, 452, 294 (b), 323, 324, 506(2) of the IPC, Section 4 of Tamil Nadu Prohibition of Harrasment of Women Act, 2002 and Section 3 of Tamil Nadu Property (Prevention of Damage and Loss), Act, 1992.
3. The learned Government Advocate for the respondents 2 and 3 submits that although charge sheet has been made ready as early as on 20.08.2018, it has not been filed before the Judicial Magistrate II, Sivagangai.
4. It appears that the petitioner filed an application on 16.06.2025, which has not been processed till date in view of the pendency of the criminal 2/5
case in the aforesaid crime number.
5. Since no case is pending against the petitioner before any criminal Court, there can be no impediment in directing the first respondent to process the petitioner's passport application.
6. Accordingly, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible.
7. It is also made clear that in case charge sheet is filed against the petitioner, the petitioner shall surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport. 8.The writ petition stands disposed of.
