ORDER

The Petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the Respondents to grant permission and necessary protection to conduct the ''Adal Padal'' programme on 28.09.2022 at 08.00 p.m. to 11.00 p.m. in connection with ''Thiru Vizha'' of Arulmighu Sri Mutharamman Thirukovil, Idaiyarkadu, Eral Taluk, Thoothukudi District. 2.The learned Additional Public Prosecutor takes notice for the Respondents. By consent, the Writ Petition itself is taken up for final disposal. 3.Heard the learned Counsel for the Petitioner and the learned Additional Public Prosecutor appearing for the Respondents. 4.The learned Counsel appearing for the Petitioner would submit that as the aforesaid festival is celebrated in a peaceful manner by the villagers, there will be no untoward incident on account of this celebration. 2/4

5.The learned Additional Public Prosecutor appearing for the Respondents objected to grant permission on the ground that there are communal problem in the village and the Petitioner is also facing charge for the offence under SC/ST Act and also it is a case in counter.

6.Considering the submission of the learned Additional Public Prosecutor, the District Collector of Thoothukudi District, is impleaded suo motu as a proper and necessary party as District Magistrate of the District concerned, dealing with Law and Order issues. The second Respondent/Superintendent of Police on consultation by the District Collector, can pass appropriate orders. Accordingly, this Writ Petition is disposed of.
