ORDER
This petition has been filed to recall the order dated 18.07.2025 in W.P(MD) No.571 of 2025 before this Court.
2. According to the learned counsel for the petitioner, the earlier order passed in W.P.(MD) No.571 of 2025 was made behind his back, without notice to the petitioner herein. Though the petitioner was arrayed as the fourth respondent, the said Writ Petition came to be disposed of by this Court without affording an opportunity of hearing to the petitioner.
3. Further, he would submit that a civil dispute between the petitioner and the fourth respondent is pending in O.S.No.19 of 2025 before the District Munsif-cum-Judicial Magistrate Court, Thiruchuli. Therefore, the petitioner submits that the observations, if any, made by this Court in W.P. (MD) No.571 of 2025 would prejudice his case in O.S.No.19 of 2025. Hence, he prays for recalling the earlier order passed by this Court in W.P. (MD) No.571 of 2025 and seeks one more opportunity of hearing, so that a fresh order may thereafter be passed.

One Seeni Naicker, who is the fourth respondent herein/petitioner therein, had filed the said Writ Petition that the petitioner herein had obstructed the public pathway, through which, the temple chariot has to be taken during the festival, thereby preventing the conduct of the temple festival. Considering the urgency projected by the petitioner therein, this Court disposed of the said Writ Petition without issuing notice to the fourth respondent therein.
5. In fact, this Court directed the official respondents to verify whether the subject pathway was described as a cart track in the revenue records. Since the official respondents reported that the subject pathway had been referred to as a cart track and in view of the allegation that the fourth respondent had placed stones and thereby obstructed the villagers from conducting the temple festival, this Court has passed the earlier order.
6. The permission granted to the fourth respondent herein in W.P.(MD) No.571 of 2025, vide order dated 18.07.2025, is no way affecting the rights of the petitioner in O.S.No.19 of 2025 on the file of the 3/6
District Munsif-cum-Judicial Magistrate Court, Thiruchuli. Therefore, there is no necessity to recall the earlier order. It is, however, clarified that the order passed in W.P.(MD) No.571 of 2025 shall not be taken into consideration, while deciding the suit in O.S.No.19 of 2025.
7. With the above observations, this Writ Miscellaneous Petition is dismissed.
