PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the learned District Munsif to dispose the I.A.No.5 of 2025 in O.S.No.176 of 2025 on the file of the I Additional District Munsif Court, Tirunelveli, within a time fixed by this Court by allowing this Civil Revision Petition.

ORDER

This petition has been filed seeking a direction to the learned I Additional District Munsif, Tirunelveli, to dispose of the petition in I.A.No.5 of 2025 in O.S.No.176 of 2025 on the file of the I Additional District Munsif Court, Tirunelveli, within a time frame fixed by this Court

2. Since no adverse orders are going to be passed against the respondents, notice to the respondents is dispensed with.

3. The petitioner herein filed a suit in O.S.No.176 of 2025 seeking partition and permanent injunction before the learned I Additional District Munsif, Tirunelveli, against the respondents herein. Pending suit, the petitioner herein filed an interlocutory application in I.A.No.5 of 2025 before the trial Court under Order VII Rule 1 r/w Section 26 CPC seeking temporary injunction restraining the first respondent from putting up any construction until the disposal of the suit. However, the said application has not yet been disposed of. Hence, the petitioner has filed this present Civil Revision Petition. 4.. In view of the above, the I Additional District Munsif Court, Tirunelveli is directed to dispose of the petition in I.A.No.5 of 2025 in O.S.No. 176 of 2025 within a period of three months from the date of receipt of a copy of this order.
