ORDER

This writ petition has been filed seeking for issuance of a writ of mandamus directing the second and third respondents to consider the petitioner's representation dated 23.09.2019 and consequently surrender all the documents to the petitioner's custody.

2. It is the case of the petitioner that he has sent a representation to the respondents 2 and 3 to surrender all the documents, which were pledged by the petitioner for agricultural loan, to him. However, the said representation has not been considered so far. Hence, the petitioner is before this Court by way of the above writ petition.

3. Heard the learned counsel on either side.

4. It is stated vide notice dated 27.08.2019, the State of Bank of India informed the sureties, who have deposited their title deeds as security for the loan taken by the petitioner, to come forward to receive their document as the loan has been discharged by the petitioner. The petitioner herein has filed this writ petition stating that all the documents have to be returned to him. This relief cannot be granted to the petitioner as the bank is required to return the document to the respective owners of the properties. Therefore, the respondent bank is directed to issue notice to all the sureties, hear them and thereafter, hand over the document to the respective parties to whom the properties belong.

5. With the above direction, this Writ Petition is disposed of. No costs.
