O R D E R

[Order of the Court was made by R.SUBRAMANIAN, J.] This Public Interest Litigation seeks the execution of the Award of the National Green Tribunal, Principal Bench, New Delhi.

2. We feel that better and more effective remedy is available to the petitioner under Section 25 of the National Green Tribunal Act, 2010 [hereinafter referred to as ''the Act'']. While Section 25 of the Act provides for execution of the awards, Section 26 of the Act imposes penalties for failure to comply with the orders of the Tribunal. The provisions of Section 26 of the Act are much more deterrent than the teeth available to this Court under Article 226 of the Constitution of India. Hence, we do not propose to entertain the Writ Petition. We leave it open for the petitioner to approach the National Green Tribunal, Southern Bench, to which the orders have been transferred from the National Green Tribunal, New Delhi. We are sure that the National Green Tribunal, Southern Bench will definitely take note of Section 26 of the Act and implement it in its letter and spirit.

3. The Writ Petition stands disposed of with the above observation. No costs.
