ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, the learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. The petitioner has filed this Writ Petition to direct the first respondent to consider the petitioner's passport application in online application File No.TR1065448137723, dated 08.06.2023.

3. The learned Government Advocate (Crl.Side) for the second respondent submits that although the petitioner has been arrayed as A15 in the FIR registered in Crime No.409/2022, dated 03.12.2022 by the second respondent/Police Station 2/5

for the offences under Sections 143, 283 and 341 of Indian Penal Code, 1860, no charge sheet has been filed, even the charge sheet has been made ready.

4. Thus, there can be no impediment in directing the first respondent to process the passport application of the petitioner.

5. Considering the fact that the passport application is filed on 08.06.2023, there is no scope for processing the same, as the application would have been closed at this distance point of time. Considering the same, the petitioner can file a fresh application, in which case the petitioner's passport application shall be processed and the passport shall be issued as expeditously as possible as per usual norms.

6. It is, however, made clear that in case, during the interregnum, charge sheet is filed against the petitioner before the concerned Court, the petitioner shall surrender the passport before the concerned Court and retrieve the same from the 3/5

said Court as and when the petitioner desires to travel abroad.

7. It is made clear that in case, the petitioner fails to comply with any of the above stipulations, the first respondent is at liberty to seize the passport of the petitioner and to hand over it before the concerned Court or in the alternative, it is open for the first respondent to take steps to cancel the passport to be issued to the petitioner.
