ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 379 of IPC and Section 21(1), 21(2) of Mines and Minerals (Development and Regulations)Act, 1957, in Crime No.122 of 2023, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 12.08.2023, based on a secret

information, the respondent police went to the place of occurrence and found a bullock cart loaded with 1⁄4 unit of river sand without valid permit. Hence the present case came to be registered.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has not committed any offences as alleged by the prosecution and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner has involved in Crime No.404 of 2021. Even after getting bail in that case, he is continuously engaged himself in the present offence.

5. Considering the facts and circumstances of this case and the fact that the petitioner has been involving in such offences continuously, this Court is not inclined to grant relief to the petitioner.
