ORDER

(Order of the Court was made by C.V.KARTHIKEYAN, J.) The contempt petition arises out of an order passed by a Coordinate Bench on 08.05.2025, wherein on HCP had been filed by a daughter complaining that her mother had gone missing on and from 18.04.2025 and in respect of which, a complaint had been lodged and an FIR had been registered in Crime No.72/2025 under the caption 'woman missing' by the Usilampatti Taluk Police Station/2nd respondent.

While disposing of the Habeas Corpus Petition, the Coordinate Bench, by order dated 08.05.2025 had directed that the investigation should be completed and the detenue should be traced as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of the above order. It had been further stated that if the detenue is identified, she should be produced before the jurisdictional Magistrate Court and intimation should be given to the petitioner. 2/5

3. A status report had been filed by the 2nd respondent/Inspector of Police, Usilampatti Taluk Police Station, wherein, it had been stated that strenuous efforts had been taken to locate the detenue. It had been further stated that one Thavamani was very familiar with the missing person for the past 10 years and that the missing person Amutha was wearing 51⁄4 sovereigns of gold thali chain and that there was a possibility of the thali chain being snatched for financial gain. It had been stated that it has been reasonably detected that Thavamani would have abducted her from Sempatti to Tiruppur. The cellphone of the missing person had also been seized. The shop, where the jewelry and the ring were sold in Tiruppur, was also identified. It had been stated that the FIR had been altered from woman missing to offences punishable under Sections 318(4), 140(3), 87, 309(4), 303(6) BNS. Thavamani had also been arrested and his confession had also been recorded on 29.10.2025.

4. Since the investigation has progressed to a substantial extent, we hold that contempt would not lie against the respondents. The contempt petition stands closed. However, we would grant time to the respondents 3/5

to file the final report in Crime No.72/2025, before the jurisdictional Magistrate Court, on or before 28.02.2026.
