ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406, 465, 468, 471, 420 IPC, in Crime No.32 1/4

of 2024 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused persons had received a sum of Rs.1,00,31,685/- from the defacto complainant and 10 others for obtaining Government Job for them and the accused who are all having close contact with the Government Officials working in various departments and utilizing the said contacts, the accused took the defacto complainant and 10 others to the Government Offices and took medical tests and verified their certificates and forged the Government seals and issued forged appointment orders and I.D cards for them and called them to come to the training classes and in the training class they received back the forged appointment orders and I.D. Cards and as such the accused cheated them. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offences as alleged by the prosecution. He further submitted that the petitioner was working as HR Manager in A1's Company and she has no access to control over financial matters or company administration. He further submitted that the 1st accused instructed the petitioner to allow certain clients to transfer money into her personal bank account, based on his 2/4

direction, the petitioner promptly transferred the received amounts to his bank account (A1) without retaining any amount for herself. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are 9 accused persons involved in this case and the petitioner is arrayed as A9. He further submitted that the petitioner along with other accused persons have cheated the defacto complainant and 10 others to the tune of Rs.1,00,31,685/- and the petitioner has received a sum of Rs.3,58,000/- through G.Pay from 11 victims. He further submitted that there are 4 previous cases pending against the petitioner and the investigation is at initial stage and if the petitioner is released on anticipatory bail, she may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner and there are 4 previous cases pending against the petitioner and also taking note of the fact that huge amounts were involved in this case and the investigation is still pending and no amounts were 3/4

recovered, if the petitioner is released on anticipatory bail, she may tamper the witnesses and abscond and hence this Court is not inclined to grant anticipatory bail to the petitioner.
