PRAYER :- For Anticipatory Bail in Crime No.542 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent 1/3

police for the offences punishable under Sections 126(2), 308(4) and 351(3) of BNS, in Crime No.542 of 2025 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 13.06.2025 at 09.00 pm., when the defacto complainant was proceeding in his Swift Dezire Car near Kuppanna Hotel Temple, the petitioner along with other accused waylaid the defacto complainant and threatened him with knife point and also taken away a sum of Rs.18,000/- from his shirt pocket. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail. 4.The learned Government Advocate (Criminal Side) submitted that there are totally two accused involved in this case and the petitioner has been arrayed as A2. The petitioner along with other accused waylaid the defacto complainant and threatened him by showing knife and also robbed a sum of Rs.18,000/- from him. He further submitted that a sum of Rs.8,000/- has been recovered and the investigation is pending and a sum of Rs.10,000/- is yet to be recovered and the petitioner is having nine previous cases. Hence, he opposed to grant anticipatory bail to the petitioner.

5.Considering the nature and gravity of the offence committed and also the manner in which, the offence was allegedly committed by the petitioner and also taking note of the fact that remaining amount of Rs.10,000/- has to be recovered and the investigation is pending, hence the custodial interrogation of the petitioner is necessary. This Court is not inclined to grant anticipatory bail to the petitioner at this point of time.
