Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent herein to issue no objection certificate pertaining to property situated at Trichy District, Thamalavarubayam Village, Trichy Municipal Ward No.3, Old S.F.No. 44/2, New T.S.No. 3929/1, as per sub-division Ward B, Block 17, T.S.No.31 admeasuring Acre 1.23 cents, within a stipulated period as may be fixed by this Court.

Mr.D.S.Harron Rasheed, learned Standing Counsel takes notice for the respondents.

2. The learned Standing Counsel for the respondents submits that the Wakf Board is the competent authority and therefore, the Chief Executive Officer and the Chariman of the Wakf Board should be impleaded.

3. Recording the above submission, the Chief Executive Officer, Tamil Nadu Wakf Board, No.1, Jaffer Syrang Street, Vallal Seethakathi Nagar,Chennai - 600 001 and the Chairman, Tamil Nadu Wakf Board, No.1, 2/5

Jaffer Syrang Street, Vallal Seethakathi Nagar,Chennai - 600 001, are suo motu impleaded as respondents 1 and 2. The existing respondent in the cause title is substituted as the third respondent.

4. Registry is directed to carry out necessary amendments in the cause title.

5. The first respondent is directed to consider the request of the petitioner for issuance of No Objection Certificate in respect of property situated at Trichy District, Thamalavarubayam Village, Trichy Municipal Ward No.3, Old S.F.No. 44/2, New T.S.No. 3929/1, as per sub-division Ward B, Block 17, T.S.No.31 admeasuring Acre 1.23 cents and pass appropriate orders on merits within a period of four weeks from the date of receipt of a copy of this order.
