ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 5(1), 5(n), 5(j)(ii) and 6(1) of Protection of Children from Sexual Offences Act, 2012 and Section 506(i) of IPC IPC in Crime No.183 of 2023, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that during the subsistence of the first marriage, it appears that the second marriage has been performed by the petitioner and a complaint was given by the defacto complainant.
3. Reading of the file shows that originally there is some sort of love affair between the defacto complainant and the petitioner. Because of the intimacy, she became pregnant and later the petitioner disconnected the contact, but performed marriage with some other girl and that was brought to the notice of the victim, she lodged a complaint before the Keeranur Police station. In the police station there was a compromise by which the petitioner married the victim girl, before the police station itself, in a nearby temple. A female child was born after that. Inspite of the undertaking given by the petitioner in the police station to take care of the victim and the child, later he failed. Because of the issue, she lodged a complaint and the case was registered.
4. Learned counsel for the petitioner would submit that now he is also ready to take care of the victim and the child.
5. The contact of the petitioner does not inspire any confidence at all. He always makes mistakes. For the first time, at the time of love affair, next after getting married to the victim girl, he cheated the victim girl. The conduct of the petitioner is not entitled him from claiming any discretionary relief from this Court.
