PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to pay the half of the remaining salary with interest to the Petitioner, which was uphold by the respondents Stores due to their financial crisis for the year 2005 to 2008 and consequently direct the respondents to solve the issue between the petitioner and credit society.

The petitioner, an erstwhile Secretary of the Madura Coats Workers Cooperative Stores, Madurai /the fourth respondent herein has filed this writ petition that he was paid 50% of salary and the remaining salary has not been paid to him. 2.When this writ petition was taken up for hearing on 18.12.2024, there was no representation for the petitioner. Therefore, this writ petition was directed to be listed today, under the caption 2/6
''for dismissal''. Even today, there is no representation for the petitioner.
3.The learned Government Advocate appearing for the respondents submits that this petitioner has indulged in misappropriation, while he was in service and therefore, an enquiry under Section 82 of the Tamil Nadu Co-operative Societies Act, 1983 was contemplated as against this petitioner. Pending the enquiry, he was paid with 50% of the salary. After completion of the enquiry, a liability of Rs.2,49,556.18/- was fixed on this petitioner. Therefore, 50% of the salary, payable to this petitioner was adjusted towards the liability. Therefore, according to the learned Government Advocate, this petitioner is not entitled for the relief sought for in this writ petition.
4. Since there is no representation for the petitioner, recording the submissions made by the learned Government Advocate, this writ petition is dismissed. No costs. Consequently, 3/6
