Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first to third respondents to grant salary, as it was applicable to the permanent employees of Tamil Nadu Civil Supply corporation with all other benefit extended to time to time including yearly pay increment and benefit of VI & VII Pay Commission, from the date of my appointment, i.e., 12.11.2001, on the basis of the petitioner's representation dated 06.10.2021.

O R D E R

The relief sought for in the present Writ Petition is to direct the respondents to consider the representation of the petitioner dated 06.10.2021.

2. According to the petitioner, she has been appointed as Sweeper on 12.11.2001 in the third respondent Corporation. However, the benefits of House Rent Allowance, City Compensatory Allowance, Yearly Increment and the benefits of VI and VII pay commission have not been paid to the petitioner from January 2002 onwards. Only the basic pay and Dearness Allowance were paid to the petitioner after https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P (MD) No. 20852 of 2021 deducting EPF, FPF etc., As on date, the petitioner has been receiving a sum of Rs.6,962/-. In this regard, she has made a representation to the authorities on 06.10.2021. Since there is no positive action, she has filed the present Writ Petition.

3. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submitted that it would suffice if the representation of the petitioner dated 06.10.2021 is directed to be disposed of, within a stipulated time limit.

4. In view of the limited scope of the relief sought for, this Court, without expressing anything on the merits of the case, directs the respondents to consider the petitioner's representation dated 06.10.2021 and pass appropriate orders, on its own merits and in accordance with law, after affording due opportunity of hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition stands disposed of. No costs.
