PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records in Crime No.134 of 2018 on the file of the Inspector of Police,Kamuthi Police Station, Ramanathapuram District and quash the same.

This Criminal Original Petition has been filed to quash the First Information Report in Crime No.134 of 2018 on the file of the Inspector of Police,Kamuthi Police Station, Ramanathapuram District.

2. The learned Additional Public Prosecutor would submit that the charge sheet has been filed before the learned Judicial Magistrate, Kamuthi concerned on 26.04.2022 and it is yet to be numbered.

3. The learned Counsel for the Petitioner would submit that the offences are attracting the punishment less than three years.

4. By way of reply, the learned Additional Public Prosecutor would also submit that section 506(2) of IPC is invoked for which punishment is seven years. The charge sheet has been laid before the learned Judicial Magistrate, Kamuthi within time but not taken on file. 2/4

5. Recording the submission made by the learned Additional Public Prosecutor, the Criminal Original Petition is dismissed. The Petitioner is at liberty to move appropriate petition at later stage. Consequently connected miscellaneous petition is closed.
