RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition No.1 imposed by this Honble Court in Crl.MP.No.5208 of 2024 dated 31.07.2024 by directing the petitioner to surrender before the Learned Sessions Judge, Mahalir Neethimandram, Madurai with two sureties and one surety shall be a blood surety without any property document and one surety with bond or any other suitable condition imposed by this Hon'ble Court.

Prayer in CRL MP(MD). 5208/ 2024 :

To suspend the sentence imposed on me in S.C No. 267 of 2019 dt. 21.12.2022 on the file of the learned Sessions Judge, Mahalir Neethimandram, Madurai and enlarge me on bail pending disposal of the appeal.

Prayer in CRL A(MD).144/2023 :

To call for the records and set aside the order of conviction and sentence passed 1/4

in S.C.No.267/2019 dated 21.12.2022 on the file of the Learned Sessions Judge, Mahalir Neethimandram, Madurai and allow this appeal and acquit the Appellants / Accused from the charge leveled against them. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUPPASAMY PANDIAN.G, Advocate for the petitioner and of MR.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition no. 8(i)imposed by this Court vide order dated 31.07.2024 in Crl.MP(MD) No. 5208 of 2024 in Crl.A.144 of 2023by granting suspension of sentence.

2. The condition is as follows:

The petitioners are directed to be enlarged on bail on executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties, of whom, one should be a blood related surety, each for a like sum to the satisfaction of the learned Sessions Judge, Mahalir Neethimandram, Madurai.

3. The learned counsel appearing for the petitioner stated that the father of the petitioner is prepared to stand as surety, but unfortunately owing to economic condition he is not able to produce a bond for a sum of Rs.25,000/- . However the other surety is ready to produce a bond for a sum of Rs.25,000/-.

4. In view of the said submission, the condition imposed by this Court vide order dated dated 31.07.2024 is modified to the effect that 2/4

" The petitioner is directed to be enlarged on bail with two sureties, of whom, one should be a blood related surety/ father and he need not produce a bond for the said sum, the other surety is directed to execute a bond for a sum of Rs.25,000/- to the satisfaction of the learned Sessions Judge, Mahalir Neethimandram, Madurai.
