The Writ Petition in W.P.(MD) No.20953 of 2025 is filed seeking a direction to the first and second respondents herein not to register any 2/6
document in respect of the property in Survey No.8 in T.S.1317/2, block No.12 Corporation ward No.85, Amman Sannathi Road, Door No.41, Madurai in light of the objection made by her husband dated 09.01.2025.
2. The Writ Petition in W.P.(MD) No.35415 of 2025 is filed for a direction to the respondents to consider and dispose of the petitioner's representation dated 18.11.2025.
3. It is the case of the petitioners that the petitioners in both the Writ Petitions are wife and husband, respectively. The petitioner in W.P. (MD) No.35415 of 2025 is the owner of the subject property, regarding which he has executed a power of attorney in favour of one Rangaraj/third respondent in W.P.(MD) No.20953 of 2025. For his business, the husband borrowed money from one Karthick/fourth respondent in W.P.(MD) No.20953 of 2025. Due to downfall of his business, he could not repay the loan, regarding which, the said Karthick lodged a complaint before the Inspector of Police, City Crime Branch Unit-III, Madurai and the same was registered in Crime No.16 of 2025 and the petitioner was taken into judicial custody on 03.06.2025. In order to grab the petitioner's property, by influencing the power of attorney 3/6
executed in favour of the said Rengaraj, the said Karthick tried to execute a sale in favour of him. Hence, the petitioner in W.P.(MD) No. 20953 of 2025 has filed this Writ Petition representing her husband. Further, the husband enlarged on bail on 02.08.2025 and filed W.P.(MD) No.35415 of 2025 to forbear the second respondent from making any encumbrance in respect of the subject property.
4. The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that totally, there are six complaints given against the petitioner in W.P.(MD) No.31415 of 2025. Hence, the Inspector of Police has sent a representation to the Sub Registrar not to make any registration in respect of the subject property.
5. The learned counsel for the intervenor would submit that he is one of the victims and opposed to make further encumbrance in respect of the subject property.
6. I have heard the submissions made by either side and perused the available records.

7. In view of the submissions made by either side, this Court thinks it fit to direct the respondents 1 and 2 to conduct a detailed enquiry and dispose of the petitioners' representations.
8. With the above observations, these Writ Petitions are disposed of by directing the respondents 1 and 2 to conduct a detailed enquiry and dispose of the petitioners' representations within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
