ORDER

The Writ Petition has been filed, invoking Article 226 of the Constitution of India, seeking orders to quash the proceedings issued by the fifth respondent vide Na.Ka.No.25/PKT TK PS/2023 dated 18.08.2024 and third respondent vide Na.Ka.No.5450/Aa4/2024 dated 16.08.2024 and direct the respondents herein to grant permission for 2/6

conducting the Horse Race on 07.09.2024 at 8.00 am onwards at Anaikaadu, Arartrupalam, Pattukottai Taluk, Thanjavur District. 2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the first, second and fifth respondents, Mr.M.Muthumanikkam, learned Government Advocate(Civil Side) takes notice for the third respondent and Mr.S.Srinivasan, learned Standing Counsel takes notice for the fourth respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.The learned Additional Public Prosecutor would submit that the fifth respondent had passed an order dated 18.08.2024 rejecting the petitioner's request for conducting Horse Race on the ground that Vinayagar Chathurthi celebration is going to take place on 07.09.2024 and other attending circumstances.

4.The learned counsel appearing for the writ petitioner would submit that in view of the rejection order, they have changed the date to 14.09.2024 for conducting Horse Race.

5.Considering the above, the petitioner is directed to give fresh representation to the fifth respondent and on receipt of the same, the fifth respondent is directed to take a decision, on or before 10.09.2024. 6.With the above direction, the Writ Petition stands disposed of.
