ORDER : The Court made the following order :- The petitioners/A1 & A2, who are facing a case for the offences under Sections 403, 406, 420, 468, 471 and 474 of IPC, in C.C.No.279 of 2022 on the file of the learned Judicial Magistrate, Uthamapalayam, seek anticipatory bail. 2.The petitioners were absent during the trial in C.C.No.279 of 2022 on the file 1/3

of the learned Judicial Magistrate, Uthamapalayam. Therefore, non bailable warrant came to be issued on 15.03.2024. Thereafter, they filed a petition in Crl.MP.No.3182 of 2024 to recall the warrant and the same was dismissed on 05.06.2024. Hence, the present petition.

3. Heard both sides.

4. Considering the argument made on behalf of the petitioners and considering the facts that the quash petition, which is pending before this Court in Crl.OP(MD) No.7758 of 2023 was dismissed by this Court today (05.09.2024) and the petitioners were absent for hearing on 15.03.2024, I am of the view that the petitioners shall surrender before the learned Judicial Magistrate, Uthamapalayam and file an application to recall the warrant. The learned Judicial Magistrate, Uthamapalayam shall consider the same on the same day itself.

5. With the above observation, this Criminal Original Petition stands disposed of.
