PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner, dated 01.06.2023 to provide drainage and sewage channel in respect of the petitioner's houses situated in I Street of Ward No.12, Door Nos.100, 101, 102 and 104 of the third respondent Town Panchayat. 1/5

O R D E R

The petitioner with a grievance that drainage and sewage channel has not been provided to the petitioner has approached this Court for a Mandamus to direct the respondents to provide drainage facility to the petitioner's house.

2.Today(07.09.2023), when this writ petition is taken up for admission, there is no representation for the petitioner. 3.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader, who takes notice for the first respondent on written instructions, which he has received from the Panchayat Secretary submits that the works have been identified and steps are taken to award contract for executing the drainage work in that particular area.

4.It is very unfortunate that even after 75 years of independence, the Panchayat, which are receiving crores of rupees from the State Government has not even provided drainage facilities to the public. The District Collector shall ensure that the Panchayat funds are utilized properly and the basic amenities such as drinking water, drainage facilities shall be provided to the public. In this case, the District Collector, Virudhuangar shall ensure that proper drainage facility shall be provided to the petitioner within a period of four weeks from the date of receipt of a copy of this order. A copy of the order shall be marked to the District Collector, Virudhunagar. No costs.
