PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned list of the contesting candidates (Form-8) passed by the second respondent vide his proceedings Nil dated Nil (affixed in the notice board on 27.08.2024) and quash the same as illegal and consequently to direct the respondents to conduct the election in a fair and transparent manner for the post of President of the Perumagalur Kanmai (Periyaeri) Water Users Association within a period that may be fixed by this Court.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ petition has been instituted to quash the list of contesting candidates (Form-8) issued by the second respondent so as to conduct election to the Tamilnadu Formers Association, namely, Perumagalur Kanmai (Periyaeri) Water Users Association.
2. The Associations are constituted under the guidelines issued by the Government for the benefit of the Ayakatudars / Formers in the particular locality. The main purpose of constitution of association is to ensure the equal distribution 2/5
of water for irrigation purpose amongst the formers as well as Kudivaram. After issuing election notification, lists of contesting candidates were published by the second respondent that list came to be challenged in the writ petition. By virtue of the interim order granted in the writ petition, elections were not conducted for the past more than one year.
3. In view of the fact that the list lost its relevant on efflux of time, it is unnecessary to adjudicate the issues on merits. Thus, the second respondent is directed to issue a fresh election notification for conducting election and complete the process within a period of three months from the date of receipt of a copy of this order.
4. In view of the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. (S.M.S., J.) & (G.A.M., J.) 26.08.2025 NCC : Yes / No Index : Yes / No am 3/5
