PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of 2nd respondent in connection with the impugned order passed in his proceedings in Na.Ka.No.1798/Aa1/2025 dated 11.06.2025 and to quash the same as illegal and arbitrary and consequently, to direct the respondents 1 to 3 to register sale deed in connection with the petitioner's agricultural land comprised in survey number 144/3 situated at Arasur Village-I, Sathankulam Taluk, Thoothukud District, without insisting the petitioner to get NOC from the 4th respondent within the time stipulated by this Court. ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order passed in his proceedings in Na.Ka.No. 1798/Aa1/2025 dated 11.06.2025 and consequently, to direct the respondents 1 to 3 to register sale deed in connection with the petitioner's agricultural land survey number 144/3 situated at Arasur village - I, Sathankulam Taluk, Thoothukud District without insisting the petitioner to get NOC from the 4th respondent within the time.

2.The contention of the petitioner is that the land belongs to his mother. However, the Arulmigu Subramaniya Swamy Temple is claiming title over the property stating that the land belongs to the temple. 3.When it is a temple land, the official respondents are bound to conduct enquiry by calling the petitioner as well as temple and then pass orders as per the order passed in the case of Sudha Ravi Kumar and Another Vs. The Special Commissioner and Others in W.P.Nos.30589 of 2013 and batch, dated 05.04.2017.
4.Therefore, the official respondents are directed to conduct an enquiry and pass orders in accordance to law. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
