O R D E R

The present Writ Petition has been filed by a retired Divisional Fire Officer, seeking a Mandamus for payment of interest for the belated disbursement of terminal benefits.

2. The petitioner has attained superannuation on 31.01.2016. However, he was not permitted to retire during the pendency of charges. Ultimately, the charges were dropped and he was permitted to retire by way of order dated 24.11.2023 and the terminal benefits were released on 17.04.2024.

3. According to the learned counsel appearing for the writ petitioner, the petitioner is entitled to interest from the due date namely from 01.02.2016 onwards. Hence, he has sent a representation to the respondents on 18.01.2025, seeking interest. Since there is no response, the present Writ Petition has been filed.

4. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 and 2 and the learned Standing Counsel appearing for the third respondent.

Considering the above said facts, the first respondent herein is directed to consider the fact that the petitioner has been exonerated from all the charges and pass orders in the light of the judgment of the Division Bench of this Court passed in W.A.(MD)No.1326 of 2021 dated 07.07.2021, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
