JUDGMENT
Today, when the matter is taken up for hearing, the Joint Compromise Memo, dated 11.11.2023, has been filed stating that compromise has been entered into between the parties on 11.11.2023.
2. The first appellant and the first respondent who have signed in the Joint Compromise Memo are present before this Court. The second appellant and the second respondent who are the children of the first appellant and the first respondent respectively are absent, though they have signed in the Joint Compromise Memo.
3. It is submitted by the first appellant and the first respondent that the second appellant and the second respondent are not present before this Court due to pre-occupation with their avocations. The first appellant and the first respondent state that the signatures found in the Joint Compromise Memo are that of the second appellant and the second respondent. It is further stated that the common wall referred to in condition (c) of the Joint Compromise Memo has already been raised and the parties are in enjoyment of the respective portion and as such the Joint Compromise Memo has been acted upon. 2/4
4. Recording the Joint Compromise Memo, dated 11.11.2023, this Second Appeal is disposed of. The said Joint Compromise Memo shall form part of the judgment and decree. No costs.
