O R D E R
The present Writ Petition has been filed by a retired employee seeking a Mandamus as against the second respondent to issue No Due Certificate and NOC to the third respondent so as to enable the petitioner to receive the monthly pension and other retirement benefits.
2. The petitioner herein has suffered an order of attachment in E.P.No. 14 of 2022 in O.S.No.4 of 2007 on the file of the Principal District Court, Tirunelveli. According to the petitioner, he had settled the entire amount in the civil suit and full satisfaction memo has been filed by the decree holder. In such circumstances, he seeks the Mandamus against the second respondent.
3. According to the learned Additional Government Pleader appearing for the respondents, unless they receive any communication from the Court raising the order of attachment, they will not issue NOC.
4. Considering the above said facts, the petitioner is directed to see that a communication is sent from the concerned Court to the second respondent 2/4
raising the order of attachment. On such receipt, the second respondent herein is directed to issue NOC to enable the petitioner to receive the terminal benefits.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
