PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to give adequate police protection for the proposed festival from 05.09.2024 to 07.09.2024 of Arulmigu Sivasudalai Maada Swamy Thirukovil, situated at Mettukudiyiruppu Village, Agastheeswaram Taluk, Kanniyakumari District.

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents 1 to 4 to give adequate police protection for the proposed festival from 05.09.2024 to 07.09.2024 of Arulmigu Sivasudalai Maada Swamy Thirukovil, situated at Mettukudiyiruppu Village, Agastheeswaram Taluk, Kanniyakumari District.

2. When the matter is taken up for hearing today, the learned counsel for the petitioner would submit that the petitioner has formed another trust and since the fifth respondent has not prepared to conduct the festival, the petitioner's group were constrained to celebrate the festival and only for that purpose, the representation came to be given.

3. The learned Additional Public Prosecutor appearing for the State would submit that the petitioner's representation is pending before the fourth respondent.

4. Considering the above, the fourth respondent is directed to issue written summons to the petitioner as well the private respondents for causing their appearance before him for enquiry and to conduct enquiry and pass orders within a period of two days from today.

5. With the above direction, this Writ Petition stands disposed of. No costs.
