Respondent Prayer :- Criminal Revision Petition has been filed under section 397 r/w 401 of Cr.P.C., to call for the records and set aside the order in STC no. 213/2021 by the learned Judicial Magistrate No.1, Kumbakonam dt. 07.07.2022 and to restore the complaint to file by allowing the above Criminal Revision petition.
ORDER:- This Revision/Appeal Petition coming on for hearing on this day under the caption 'Extension of time for 'Lower Court' and upon perusing earlier order dated 13/06/2024 and the requisition submitted by the Judicial Magistrate No.I, Kumbakonam, Thanjavur District in D.No.586/2025 dated 05.04.2025 through Chief Judicial Magistrate, Thanjavur at Kubakonam in D.No.916/2025/A1, dated 08.04.2025 seeking further six months time to dispose of the case in S.T.C.No.213 of 2021, this Court made the following Order:
'This matter is listed today under the caption for 'extension of time'.
2. It is evident from the records that this Court vide order, dated 13.06.2024, directed the learned Judicial Magistrate No.I, Kumbakonam, to dispose of the case in S.T.C.No.213 of 2021 within a period of six months from the date of restoration. The learned Judicial Magistrate No.I, Kumbakonam, has submitted a requisition, through the learned Chief Judicial Magistrate, Thanjavur at Kumbakonam, dated 08.04.2025, stating that bailable warrant is pending against the respondent/accused and seeks further six months time to dispose of the case.
3. Considering the reasons assigned, this Court is inclined to grant four months time to dispose of the case.
4. Accordingly, the learned Judicial Magistrate No.I, Kumbakonam, is hereby directed to dispose of the case in S.T.C.No.213 of 2021 within a period of four months from the date of receipt of copy of this order. The learned Judicial Magistrate No.I, Kumbakonam, is directed to address a letter to the concerned Superintendent of Police for early execution of warrant.'
