To call for the records relating to the order in S.C.No.133 of 2019 dated 24.01.2023 on the file of II Additional District and Sessions Judge, Tiruchirapalli, set aside the judgment and acquit the appellants/Accused 1 & 2 herein. 1/4

Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.GANESAMOORTHI.K, Advocate for the petitioners and of Mr.S.RAVI, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This application has been filed seeking to relax the condition imposed while granting suspension of sentence to the petitioners vide order dated 28.06.2024.

2. While granting suspension of sentence, the condition imposed was that the petitioners shall stay at Tirunelveli and report before the Inspector of Police, Tirunelveli Town Police Station, Tirunelveli District every day at 10.30a.m., until further orders.

3. In the affidavit filed, it has been stated that the petitioners are hailing from poor family and could not meet out the expenses of staying in another city for a long period and they also have age old parents.

4. The learned Additional Public Prosecutor stated that the petitioners are complying with the conditions from 02.07.2024 with out fail.

5. Taking into consideration all the factors the said condition alone is modified 2/4

to the effect that the petitioner shall report before the respondent police/ Inspector of Police, Srirangam Police Station, Tiruchirapalli District on every Saturday at 10.30 a.m., until further orders.
