The Chief Head Warder of Special Prison for women, 1/5

Madurai has filed this writ petition that she was directed to vacate the quarters, which was allotted to this petitioner, on the ground that this petitioner is frequently quarreling with her neighbour, who is an another Warder. The petitioner with a grievance that this order has been passed as against this petitioner alone has approached this Court. 2.The learned counsel appearing for the petitioner submits that the petitioner's neighbour alone has created a problem, however the petitioner was penalized, with a direction to vacate the quarters. 3.The learned Government Advocate appearing for the respondent submits that considering the nature allegation as against this petitioner and her neighbour, this Court, by earlier order, dated 03.12.2024, directed the learned Government Advocate to ascertain as to whether the petitioner and her neighbour can be accommodated in other quarters, by making an alternative arrangement. 2/5

4.The learned Government Advocate submits that there is no other vacancy in the quarters, however, after the order passed by this Court and after the order, directing the petitioner to vacate the quarters, the petitioner as well as the neighbour have not quarreled each other for the past two years.

5.This Court considered the rival submissions made also perused the materials placed on record.

6.The petitioner, who is working as a Chief Head Warder is residing in the quarters, which was allotted to her. It appears that she is having some issues with her neighbour, who is also a Warder. Since they have been frequently quarrelling, they have been directed to vacate the quarters. Now, it is reported that after the order, directing them to vacate the quarters, they are keeping silence and there is no complaints whatsoever.

7.In view of the above, this writ petition is disposed of with a direction to the respondents to get an undertaking from both the petitioner as well as the neighbour that they will not quarrel with each other in future and create any disharmony. The respondents are directed to recall the order, directing the petitioner to vacate the quarters. No costs.
