ORDER

This writ petition has been filed seeking for issuance of writ of mandamus directing the respondents to settle the estimated cost of Rs.7,48,000/- for dug open well to the petitioner within time frame to be fixed by this Court based on the representation dated 23.01.2023 and 20.03.2023.

2. Heard Mr.S.Kumar, learned counsel appearing for the petitioner and Mr.D.Gandhiraj, learned Special Government Pleader, who takes notice on behalf of the first respondent. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

The petitioner applied to the second respondent for digging Well in her land as per the Welfare Scheme for marginal farmers introduced by the Central Government, whereby the Central Government is granting monetary benefit for marginal farmer, who dug a Well in his/her own land and the work shall execute through panchayat by using workers, who registered their names under Mahatma Gandhi National Rural Employment Guarantee Scheme. Thereafter, the second respondent granted administrative sanction to the petitioner through a proceedings dated 21.12.2020. Pursuant to the same, the work was commenced and the 2/4

petitioner paid wages to the workers, who involved for dug the Well, from her own cost. After the completion of work, the estimated cost of Rs.7,48,000/- for dug the Well was not paid to the petitioner. In this regard, the petitioner has given a representation to the first respondent. But, the same has not been considered so far. Hence, the petitioner is before this Court.

Considering the facts and circumstances of the case and as the writ petition has been filed only to consider the representation of the petitioner, the first respondent is directed to consider the petition mentioned representation of the petitioner and pass order on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
